1. Introduction & Agreement

Welcome to RentalLogicsKerala. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "Renter," "You") and RentalLogicsKerala ("Company," "We," "Us," "Our") regarding the rental of motorcycles and bikes.

By accessing our website, making a booking, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

Important: If you do not agree with any part of these Terms, you must not use our services. Your continued use of our services constitutes acceptance of these Terms.

2. Eligibility Requirements

To rent a bike from RentalLogicsKerala, you must meet the following requirements:

Age Requirements

  • Minimum age: 18 years for bikes up to 150cc
  • Minimum age: 21 years for bikes above 150cc
  • Maximum age: 65 years (special terms may apply)

License Requirements

  • Valid driving license with two-wheeler endorsement
  • License must be held for at least 1 year
  • International riders must have a valid International Driving Permit (IDP)
  • License must be valid throughout the entire rental period

Documentation Required

  • Valid government-issued photo ID (Aadhaar, Passport, PAN Card)
  • Original driving license (photocopies not accepted)
  • Proof of address
  • Contact information (phone number and email)
  • Emergency contact details

3. Booking & Reservation

3.1 Booking Process

  • Bookings can be made online through our website, mobile app, or by contacting customer support
  • All bookings are subject to vehicle availability
  • Advance booking is recommended, especially during peak seasons
  • Booking confirmation will be sent via email and SMS

3.2 Payment Terms

  • Full payment or partial payment (as specified) must be made at the time of booking
  • Accepted payment methods: Credit/Debit Cards, UPI, Net Banking, Digital Wallets
  • Payment gateway charges, if any, are borne by the customer
  • All prices are in Indian Rupees (INR) and include applicable taxes

3.3 Security Deposit

A refundable security deposit is mandatory at the time of bike pickup:

  • Bikes up to 150cc: ₹3,000 - ₹5,000
  • Bikes above 150cc: ₹5,000 - ₹10,000
  • Premium/Sport bikes: ₹10,000 - ₹20,000
  • Deposit can be paid via cash, card, or online transfer
  • Refund processed within 3-5 business days after bike return

4. Rental Period & Extensions

4.1 Rental Duration

  • Minimum rental period: 4 hours (or as specified)
  • Hourly, daily, weekly, and monthly rental options available
  • Rental period starts from the agreed pickup time
  • Grace period: 30 minutes (beyond this, late charges apply)

4.2 Extensions

  • Extensions must be requested at least 2 hours before the scheduled return time
  • Extension subject to vehicle availability and additional charges
  • Unauthorized extensions will incur penalty charges (1.5x normal rate)

4.3 Late Return Policy

  • 0-30 minutes late: No charge (grace period)
  • 31 minutes - 2 hours late: ₹200 penalty
  • 2-4 hours late: ₹500 penalty + hourly charges
  • More than 4 hours late: Full day charge + ₹1,000 penalty
  • More than 24 hours late without notification: Police report may be filed

5. Vehicle Use & Restrictions

5.1 Permitted Use

  • Bike must be used for personal transportation only
  • Must be operated on paved roads and authorized routes
  • Must comply with all traffic laws and regulations
  • Helmets must be worn at all times (provided by us)
  • Maximum 2 riders (driver + 1 pillion passenger)

5.2 Prohibited Uses

The following activities are strictly prohibited:

  • Racing, rallying, or speed competitions
  • Stunt riding or reckless driving
  • Off-road or rough terrain riding
  • Carrying more than authorized number of passengers
  • Transporting illegal substances or contraband
  • Commercial use (delivery, taxi services, etc.)
  • Subleasing or lending to third parties
  • Riding under influence of alcohol or drugs
  • Modifications or tampering with the vehicle
  • Removing GPS tracking device (if installed)

5.3 Geographic Restrictions

  • Bike must remain within Kerala state unless prior written approval obtained
  • Hill station rides require prior notification
  • Interstate travel may incur additional charges and insurance coverage

6. Insurance & Liability

6.1 Insurance Coverage

  • All bikes are covered by comprehensive insurance
  • Third-party liability coverage included
  • Personal accident insurance available at additional cost
  • Insurance does not cover damages due to prohibited use

6.2 Customer Liability

The customer is liable for:

  • Any damage to the bike during rental period (subject to insurance terms)
  • Traffic violations, fines, and penalties incurred
  • Loss or theft of bike due to customer negligence
  • Damage caused by prohibited use or violations of these Terms
  • Cost of lost keys, documents, or accessories

6.3 Accident Reporting

In case of an accident, you must:

  1. Immediately inform RentalLogicsKerala (within 2 hours)
  2. File a police report (FIR) if required
  3. Not admit liability or make statements to third parties
  4. Cooperate fully with insurance investigation
  5. Provide all necessary documentation and evidence

7. Maintenance & Breakdown

7.1 Pre-Rental Inspection

  • Vehicle will be inspected jointly before handover
  • Any existing damages will be documented and photographed
  • Customer must report any issues immediately at pickup
  • Failure to report existing damage may result in liability

7.2 During Rental Period

  • Customer responsible for checking oil, tire pressure, and basic maintenance
  • Regular fuel top-ups required (bike should be returned with full tank)
  • Any mechanical issues must be reported immediately
  • Do not attempt repairs without our authorization

7.3 Breakdown Assistance

  • 24/7 roadside assistance available
  • Free assistance for mechanical failures (not due to misuse)
  • Replacement bike provided if repair takes more than 2 hours
  • Customer responsible for assistance costs if breakdown due to misuse

8. Return Policy

8.1 Return Requirements

The bike must be returned:

  • At the agreed location and time
  • In the same condition as received (normal wear and tear excepted)
  • With full fuel tank (refueling charges apply otherwise)
  • Clean and free from any personal belongings
  • With all provided accessories (helmet, locks, documents)

8.2 Post-Return Inspection

  • Vehicle will be inspected for damages
  • Inspection report will be prepared jointly
  • Security deposit adjustments (if any) will be communicated
  • Refund processed within 3-5 business days

8.3 Refueling Charges

If bike not returned with full tank:

  • Fuel cost + ₹200 service charge will be deducted
  • Estimated based on fuel gauge reading

9. Cancellation & Refunds

In summary:

  • 72+ hours before rental: 100% refund
  • 48-72 hours: 50% refund
  • 24-48 hours: 25% refund
  • Less than 24 hours: No refund

10. Privacy & Data Protection

Your personal information is collected and processed in accordance with our Privacy Policy.

  • We collect necessary information for rental processing and legal compliance
  • Your data is stored securely and not shared with unauthorized third parties
  • GPS tracking may be used for vehicle security (disclosed at booking)
  • You have the right to access, correct, or delete your personal data

11. Limitation of Liability

  • RentalLogicsKerala is not liable for any personal injury, death, or property damage arising from your use of the rented bike
  • We are not responsible for delays, cancellations, or service interruptions due to circumstances beyond our control (force majeure)
  • Maximum liability limited to the rental charges paid for the affected booking
  • Customer acknowledges that riding involves inherent risks and assumes full responsibility

12. Governing Law & Jurisdiction

  • These Terms are governed by the laws of India
  • Courts in Kerala, India shall have exclusive jurisdiction
  • Any disputes will be subject to Kerala state jurisdiction
  • Arbitration clause: Disputes may be resolved through arbitration as per Indian Arbitration Act

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.
